Given it's a defunct label I think you'd get away with it.

The actual imagery of 2 Tone has become almost as famous as the music itself. The famous black and white chequered design has become synonymous with ska while Walt Jabsco has graced as many badges, poster and T-shirts as any human music icon ever has. While the concept of Walt was simply a label design for the first 2 Tone single he went on to sell vast quantities of (often illegal) merchandise which the label received no royalties from, as the legal side and hence the merchandising of 2 Tone was virtually non existent.

It’s not just among the 2 Tone faithful that Walt Jabsco is held in such high esteem. The die cut 2 Tone sleeve is listed among the most memorable record sleeves of all time, taking its place along side the likes of Jamie Reid’s artwork for the Sex Pistols and The Beatles Sergeant Pepper sleeve. Like all great design, the artwork captured the idea simply & perfectly.

Dammers loosely based the design of Jabsco on a picture of Peter Tosh from the cover of ‘The Wailing Wailers’ album, he liked the look that Tosh cut, describing it as ‘Defiant & Jamaican & Hard’. Walt Jabsco got his name from an old American bowling shirt that Dammers owned.

True, and other than women I can go down from too much meds, too little food or too much un-fed exercise, and spirits have a history of knocking me down pretty swiftly, but as Oasis once sang 'I don't feel down'...

A jobless day so I've fettled the thickness planer cutter block and have 7mm thick planks so far, small cuts as the machine's french and rebel's against oak & hard work and will plane to 10mm thick but I've bodged it to go a bit thinner.

A 'loose' question, what would I be contravening if I was to sell some stash boxes with the 'two tone records' label inlaid on them?

Context, the 'two tone man' or the 'Walt Jabasco' image that makes up the label is in black, I have black wood which will inlay on light wood quite well (I think) and a pile of oak strips so fancy a crack as as a novelty item will sell, I can see the image on posters/mugs/t-shirts and no © on them, would that indicate it's ok to use the image?

That doesn't mean I'll follow the rules but it'd be nice to know what they are and google isn't my friend.

You will be infringing copyright laws. The image is recognised brand and the current brand owner can sue you for breach of copyright and you could end up paying a fine, legal fees and a royalty (a percentage of the profit you made ne every single sale).

It’s not enough to say ‘they’ll never bother with me/find me etc’ because if you’re selling on any public forum, anyone can easily notify the copyright holder.

There is no real grey area, but as someone who works in publishing I would say that. If someone produces a creative image, the copyright is there and automatic, whether you realise it or not. If you want creativity please respect copyright.

What I'm commonly seeing is 'records' removed from the image, and you mention 'every single sale' of which there'll be no more than 5 made, including mine which is the prototype in progress with no guarantee of success.
